This Alpha Participation Agreement (the "Agreement") is entered into between you ("Participant" or "you") and Anders Backman, an individual residing in Sweden, operating under the project name "Shoehorn" ("Shoehorn", "we", "us", or "our").
By registering for or accessing the Shoehorn alpha program, you agree to be bound by this Agreement.
1.1 The Shoehorn alpha program provides early access to pre-release software and services (the "Alpha Services") for testing and evaluation purposes.
1.2 The Alpha Services are provided "as is" and "as available" without warranties of any kind. Features may change, break, or be removed without notice.
1.3 We reserve the right to modify, suspend, or terminate the alpha program or your access at any time without prior notice.
2.1 "Confidential Information" means all non-public information about Shoehorn disclosed to you, including but not limited to: the Alpha Services, features, functionality, user interface designs, architecture, roadmaps, business plans, and any information marked as confidential.

2.3 Confidential Information does not include information that: (a) is or becomes publicly available through no fault of yours; (b) was rightfully known to you prior to disclosure; or (c) is independently developed by you without use of Confidential Information.
2.4 You may share general, non-specific feedback about your experience (e.g., "I'm testing a new developer platform") but may not share screenshots, specific features, technical details, or any other Confidential Information without our written permission.

4.1 We welcome and encourage feedback about the Alpha Services. Any feedback, suggestions, or ideas you provide may be used by us without any obligation to you.
4.2 You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate any feedback into our products and services.
5.1 We collect and process personal data necessary to provide the Alpha Services, including your name, email address, and usage data.
5.2 Your data is stored securely and will not be sold to third parties.
5.3 As this is alpha software, we recommend not storing sensitive or production data in the Alpha Services.
5.4 We may collect anonymized usage analytics to improve the Alpha Services.
6.1 All intellectual property rights in the Alpha Services remain with Shoehorn. This Agreement does not grant you any ownership rights.
6.2 You retain ownership of any data you upload to the Alpha Services.
7.1 To the maximum extent permitted by law, Shoehorn shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
7.2 Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim (which, for the free alpha, is zero).
8.1 This Agreement is effective upon your registration and continues until terminated.
8.2 Either party may terminate this Agreement at any time for any reason.
8.3 The confidentiality obligations in Section 2 shall survive termination for a period of three (3) years.
8.4 Upon termination, you must cease using the Alpha Services and, upon request, return or destroy any Confidential Information in your possession.
9.1 This Agreement constitutes the entire agreement between you and Shoehorn regarding the alpha program.
9.2 We may update this Agreement from time to time. Continued use of the Alpha Services after changes constitutes acceptance of the updated terms.
9.3 This Agreement shall be governed by and construed in accordance with the laws of Sweden.
9.4 Any disputes arising from this Agreement shall be resolved through arbitration in Stockholm, Sweden, in accordance with the rules of the Stockholm Chamber of Commerce.
